Plain-language summary
SMSKit is a hosted service for sending SMS from your own phones and SIMs. Use it for legitimate, consented messaging — OTPs, alerts, transactional and two-way messages. No spam, no unsolicited bulk marketing, no fraud or illegal content. Get recipient consent, honor opt-outs, and respect carrier rate limits.
This is scaffolding pending legal review — not legal advice. Final wording will be reviewed by counsel before launch.
1. The service
SMSKit provides a managed platform that routes messages to Android phones and SIMs you supply and control. You are responsible for your phones, SIMs, and your carrier relationship.
2. Acceptable Use Policy
You agree not to use SMSKit to:
- Send spam or unsolicited bulk messages.
- Send fraudulent, deceptive, or illegal content.
- Message recipients who have not consented or who have opted out.
- Circumvent carrier rate limits or anti-abuse controls.
You must obtain recipient consent where required by law and honor opt-out requests. STOP / opt-out handling is built into the platform to help with compliance.
3. Carrier rate limits
Consumer SIMs are rate-limited by carriers. SMSKit is designed for your own controlled volume, not mass marketing; per-device throttling protects your numbers from carrier flags.
4. Billing
Paid plans are billed per phone slot (KES 10/phone/month or KES 96/phone/year) via Paystack. You can add or remove phones from the billing page; see Pricing for details.
5. Data processing
We process message data on your behalf as described in our Privacy Policy. Business customers can request a data-processing addendum (DPA).
